ব্যবহারের শর্তাবলীঃ

ভূমিকাঃ আপনাকে স্বাগতম, “ফাইন্ড মাই অ্যাডভোকেট” অ্যাপে ও ওয়েব সাইটে। আমাদের এখানে বর্ণিত ব্যবহারের শর্তাবলী (সম্মেলিত ভাবে, “ব্যবহারের শর্তাবলী” বা এই “চুক্তি”) আপনি অ্যাপ ব্যবহারকারী অ্যাডভোকেট এবং ফাইন্ড মাই এ অ্যাডভোকেট অ্যাপ কর্তৃপক্ষের মধ্যে একটি আইনী চুক্তি গঠন করে।

আপনি যদি নিম্নক্ত শর্তাবলীর দ্বারা আবদ্ধ হতে সম্মত হন তবেই অ্যাপ / ওয়েবসাইট ব্যবহার করুন অন্যথ্যায় রাজি না হলে অ্যাপ / ওয়েবসাইট ব্যবহার হতে বিরত থাকুন।

আমরা অ্যাপ / ওয়েবসাইট’টির যে কোন প্রকারের নীতিমালা পরিবর্তন কিংবা সংযোজন করার ক্ষমতা সংরক্ষন করি। আপনি আমাদের কাছে অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে এবং আইনী সেবার সহায়তাদানকারী হিসাবে গণ্য করা হবে।

আমরা বিশ্বাস করি যে, আপনি নিম্ন লিখিত শর্তাবলী সুষ্ঠভাবে মেনে চলবেনঃ

১) এই অ্যাপ / ওয়েবসাইটের উদ্দেশ্যে কেবল আইনী তথ্যমূলক বিষয়বস্তু সরবরাহ করা এবং অ্যাপ ব্যবহারকারী চাহিদার ভিত্তিতে আইনী পরামর্শদাতার (অ্যাডভোকেট)সাথে যোগাযোগ করিয়ে দেয়া।

২) আপনি অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে অ্যাপ ব্যবহারকারী গ্রাহক আইনী প্রশ্নের উওর “কুইক চ্যাট” এর মাধ্যমে দিতে বাধ্য থাকিবেন এটা উভয়ের জন্য সম্পর্ণ ফ্রী। “কুইক চ্যাটে” একান্ত ব্যক্তিগত কোন ছবি / অসৌজন্যমূলক কোন কথা কিংবা বক্তব্য প্রদান করিলে অ্যাপ ব্যবহারকারী অ্যাডভোকেট রেজিষ্ট্রেশন বাতিল বলে গণ্য হবে।

৩) অ্যাপ ব্যবহারকারী গ্রাহক কোন আইনী সেবা গ্রহণের জন্য, (ফাইন্ড মাই অ্যাডভোকেট) অ্যাপের মাধ্যমে কোন অ্যাডভোকেট সাথে মোবাইলে যোগাযোগ/চেম্বারে স্বাক্ষাৎ করতে চাইলে নির্ধারিত বুকিং চার্জ প্রদান করতে বাধ্য। বুকিং চার্জ প্রদান স্বাপেক্ষে আমরা অ্যাপ ব্যবহারকারীকে অ্যাডভোকেট সাথে যোগাযোগ করিয়ে দিবো অর্থাৎ আপনার মোবাইল নাম্বার ও চেম্বার ঠিকানা তাকে দিয়ে দেওয়া হবে তারপর আপনি অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে সম্পূর্ন নিজ দায়িত্বে এবং স্বজ্ঞ্যানে সাক্ষাৎতের সময়সূচি নির্ধারণ করিবেন।

এক্ষেত্রে উল্লেখ থাকে যে,

অ্যাপ ব্যবহারকারী গ্রাহক কর্তৃক কোন অ্যাডভোকেটকে প্রাথমিক অবস্থায় প্রদানকৃত বুকিং চার্জের ভিত্তিতে অ্যাডভোকেট উক্ত গ্রাহককে কি কি ধরনের সহায়তা দিতে বাধ্য থাকিবেঃ

ক) অ্যাপ ব্যবহারকারী গ্রাহকের আইনী সমস্যার বিস্তারিত শুনে কার্যপ্রণালী নির্ধারণ।

খ) অ্যাপ ব্যবহারকারী গ্রাহক ও অ্যাডভোকেটের মধ্যে প্রাথমিক পর্যায়ের সংক্ষিপ্ত আলোচনা হতে পারে।

গ) সমস্যার বিস্তারিত সংক্রান্ত কাগজ-পত্র প্রাথমিক যাচাই বাছাই হবে।

ঘ) অ্যাপ ব্যবহারকারী গ্রাহক এবং অ্যাডভোকেটের মধ্যে মামলা’র পূর্ববর্তী এবং মামলা পরবর্তী পরিচালনা সংক্রান্ত যাবতীয় খরচ ও অ্যাডভোকেটের সম্মানী বিষয়ক আলোচনার ভিত্তিতে নির্ধারণ করে নিতে হবে। (অ্যাডভোকেটের দক্ষতা ভেদে তার আইনী ফী / সম্মানী পরিবর্তন হতে পারে) ।
ঙ) প্রাথমিক পর্যায়ে অ্যাপ ব্যবহারকারী গ্রাহকের দ্বারা প্রদানকৃত বুকিং চার্জের ভিত্তিতে সাক্ষাৎতের পরে কোন অবস্থাতেই অ্যাপ ব্যবহারকারী গ্রাহককে ভিন্ন খাতে প্রভাবিত করা যাবেনা।

অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে আপনি যদি অ্যাপ ব্যবহারকারী গ্রাহক কর্তৃক গ্রহণকৃত বুকিং মানি
গ্রহনের দুই কার্য দিবসের মধ্যে গ্রাহকের সাথে যোগাযোগ না করেন কিংবা চেম্বারে সাক্ষাৎ করতে ব্যর্থ হন তবে বুকিং মানি থেকে আপনার প্রাপ্ত সম্মানী কর্তন করা হবে।

৪) আমরা (ফাইন্ড মাই অ্যাডভোকেট) শুধুমাত্র তৃতীয় পক্ষ হিসাবে অ্যাপ ব্যবহারকারী গ্রাহককে অ্যাডভোকেটের সাথে যোগাযোগ করিয়ে দেই। কোন অ্যাপ ব্যবহারকারী গ্রাহক স্বজ্ঞ্যানে অ্যাপ থেকে প্রাপ্ত অ্যাডভোকেটের সাথে যোগাযোগ করে ওকালতনামায় অ্যাডভোকেটকে মামলা পরিচালনা করার ক্ষমতা দেওয়ার পূূর্বে অ্যাপ ব্যবহারকারী অ্যাডভোকেট তার মক্কেলের নিকট মামলা পরিচালনা সংক্রান্ত যাবতীয় খরচ ও তার সম্মানী বিষয়ক আলোচনা শেষ করে নিবেন। ওকালতনামায় ক্ষমতা প্রদানকারী মক্কেল এবং অ্যাডভোকেট মধ্যে সংঘঠিত যে কোন প্রকার লেনদেন,কার্যপ্রনালী কিংবা কোন সমস্যার জন্য আমরা (ফাইন্ড মাই অ্যাডভোকেট অ্যাপ এবং ওয়েবসাইট) কর্তৃপক্ষ কোনভাবেই দায়ী থাকবো না।

৫) “ফাইন্ড মাই অ্যাডভোকেট অ্যাপ” ব্যবহারকারী অ্যাডভোকেট ‘অ্যাডভোকেসি প্রোফাইল’ ক্রিয়েটের ক্ষেত্রে ইচ্ছাকৃতভাবে বাংলাদেশ বার কাউন্সিল এর লাইসেন্স নাম্বার এবং নিজ জেলার আইনজীবী সমিতির সদস্য নাম্বার বা কোন ভূল/মিথ্যা তথ্য প্রোফাইলে সংযোজন মিথ্যার আশ্রয় নিলে করলে সেটার জন্য শুধুমাত্র উক্ত অ্যাপ ব্যবহারকারী অ্যাডভোকেটই দায়ী থাকিবে।
এক্ষেত্রে উক্ত অ্যাপ ব্যবহারকারী অ্যাডভোকেট দ্বারা সংযোজিত মিথ্যা/ভূল তথ্যের জন্য (ফাইন্ড মাই অ্যাডভোকেট অ্যাপ এবং ওয়েবসাইট কর্তৃপক্ষ) কোনভাবেই দ্বায়ী থাকিবেনা।

৬) অ্যাপ ব্যবহারকারী গ্রাহক ওকালতনামায় স্বাক্ষর প্রদানের মাধ্যমে আপনার মক্কেল হিসাবে গণ্য হবে। উক্ত মক্কেল অ্যাডভোকেট এর নিকট হতে (নো অবজেকশন সার্টিফিকেট/ অনাপত্তিপত্র) গ্রহণ করে অ্যাডভোকেট পরিবর্তনের অধিকার রাখেন।

৭)অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে সামাজিক যোগাযোগের মাধ্যমে আপনি এই অ্যাপ বিষয়ক কোন প্রকারের বিজ্ঞাপন,প্রচারণা এবং বিরুপ মন্তব্য করা থেকে বিরত থাকতে বাধ্য থাকিবেন। কোন ভাবে উক্ত অ্যাপে রেজিস্ট্রেশন থাকাকালীন অবস্থায় কোন অ্যাডভোকেটের বিরুদ্ধে বিজ্ঞাপন/প্রচারনা চালানোর অভিযোগ প্রমানিত হলে উক্ত অ্যাডভোকেটের অ্যাপে রেজিস্ট্রেশন বাতিল হবে এবং উক্ত অভিযোগ সম্পর্কিত শাস্তি বিষয়ক বাংলাদেশ বার কাউন্সিলের [Canons of Professional Conduct and Etiqette এর চ্যাপ্টার ১ এর ২ নং বিধি অনুযায়ী কোন সিদ্ধান্তের জন্য (ফাইন্ড মাই অ্যাডভোকেট অ্যাপ এবং ওয়েবসাইট কর্তৃপক্ষ) কোনভাবেই দ্বায়ী থাকিবেনা।
আমি অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে পেশাগত ক্যনন অফ প্রফেশোন্যাল কন্ডাক্ট এন্ড ইটিকুইটি/ইথিক এর উল্লেখিত বিধান মানিয়া চলিবো এবং পেশাগত অসাদাচরণের কারনে বাংলাদেশ বার কাউন্সিল অর্ডার এ্যান্ড রুলস ১৯৭২ এর ৩২(১) অনুচ্ছেদ অনুযায়ী বাংলাদেশ বার কাউন্সিল দোষী অ্যাডভোকেটের জন্য শাস্তির বিধান করতে পারবে।

নিজ দ্বায়িত্বে উপরোক্ত শর্তাবলী সমূহ অ্যাপ ব্যবহারকারী অ্যাডভোকেট হিসাবে স্বজ্ঞ্যানে পড়েছেন ও বুঝতে পেরেই (ফাইন্ড মাই অ্যাডভোকেট অ্যাপ) ডাউনলোড করছেন এবং একাউন্ট ক্রিয়েটের বিষয়ে সম্মত হয়েছেন।

Introduction: You are welcome in the App and Website of “Find my Advocate” . Here of use of described using terms and condition (“Collectively “using terms & conditions” or this “Agreement”, among you are the App user Advocate and Find my Advocate app authority does build one of legal agreement.

If you are compiled to engaging with the following terms & conditions, then let to use App/website, otherwise if not to be agreed, then let to restrain from using of App/Website.

We are to keep preserve the power to change or addition of any kinds of principles of the App/Website. You will be treated to us as an App user Lawyer and to be treated as an assistance of Legal Service.

We believe that you will smoothly be maintained of the following written terms & conditions:

1) To supply only legal information basis subject matter in view of App/Website and on the basis of demand of App user to be communicated with the legal adviser (advocate).

2) As you are an App user Advocate, App user client of legal questions answer through “Quick Chat” shall be bound to give, the same is free for both the sides. In the “Quick Chat” if there is given of kinds of personal photograph/any kinds of disrespectful word or statement, then App user Advocate Registration shall be treated as cancel.

3) App user client for taking of any kinds of legal service, through (Find my Advocate) App if it wanted to be communicated with any Lawyer in Mobile/wanted to meet in the Chamber, then shall be bound to be given of fixed booking charge. Due to the cause of giving booking charge, we will be made to communication with the lawyer to the App user that means your Mobile Number and Chamber Address will be given him, then you an App user advocate in fully own responsibility and in full sense shall be fixed of meeting time schedule.

In this case should be mentioned that,

By the App user client to any Lawyer in the primary stage of given book charge basis shall be bound to provide which kinds of assistance to the said clients by the Lawyer:

a) After details heard of legal problems of App user client shall to fixing of programs.
b) Among the App using client and Lawyer may be happened of short discussion in the preliminary stage.
c) Problems of details related documents shall be made of primary verification and sorting.
d) Among the app user client and lawyer, case/suit previous and case/suit after operation related all kinds of expenditure and on the basis of discussion in relation of remuneration of the lawyer shall be taken with fixing. (Legal Fee/Remuneration may be changed as per experience of the lawyer).
e) In the Primary stage by the App user client, on the basis of given booking charge and after meeting, to the App user client at any stage could not be influenced in other sector.
As you are one of the App user Lawyer, if you are by the App user client of accepted booking money acceptance within two working days, if does not communicate with the client or unable to meet into the chamber, then your payable remuneration from the booking money shall be deducted.

We are (Find my Advocate) as only the third party do communicate of App user client to the lawyer. Any kinds of App user client in consciously after communicate with the lawyer received from App and in the Power of Attorney (Vokalatnama) before giving power to run case/suit to the lawyer, App user Lawyer to his client case/suit operation related all kinds of expenditure and his remuneration related discussion shall be performed. Among the Client giving power to the Power of Attorney (Vokalatnama) and Lawyer, any kinds of transaction, procedure or any kinds of problem purpose, we have (Find my Advocate App and Website) authority shall not be liable by any means.
“Find my Advocate App” user Advocate in the case of creating “Advocacy Profile” in self-willingly of License Number of Bangladesh Bar Council and own District’s Lawyer Society’s membership number or any kinds of wrong/false statement to add into the profile if is taken shelter of falsification, for it, the only the said App use Advocate shall be liable. In this case, by the said App user lawyer of added false/wrong information purpose (Find my Advocate App and website authority) shall not be liable by any means.
App user client through signing of Power of Attorney (Vokalatnama) shall be treated as your client. The said client from the Lawyer after taken (No Objection Certificate) shall keep right to change of Lawyer.
As one of the App user Lawyer, through the social communication, you any kinds of advertisement, publication and adverse remarks in relation of this App to make shall be bound to restrain. By any means, in the said App in the period registration remaining, against of any lawyer, if there is proved to run advertisement/publication, then in the App of the said Lawyer shall be cancel of registration and in relation of the said complaint, according to the Rule 2 of Chapter 1 of Canons of Professional Conduct and Equity, for any kinds of decision (Find my Advocate App and website authority) shall not be liable by any means. As I am an App user Lawyer shall be maintained rules about Canons of Professional Conduct and Equity/Ethic and due to the cause of professional misconduct according to the paragraph 32(1) of Bangladesh Bar Council Order and Rules, 1972, Bangladesh Bar Council could be maintained punishment for the guilty advocates.

Due to own responsibility have read out in consciously of above mentioned terms & conditions as an App user Advocate and have understood (Find my Advocate App) has made to download and complied about Account creating.
